Terms of Service

Welcome to LaunchPad. These Terms of Service ("Terms") govern your use of the LaunchPad website builder at launchpad.codes and every site, feature, and service we provide (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use LaunchPad.

1. What LaunchPad is

LaunchPad is an AI-assisted website builder: you describe what you need, and our AI designs, builds, and publishes a website for you. The Service includes site editing, hosting on a launchpad.codes address, optional custom domains, and hosting plans that include features such as visitor analytics, search-engine submission, contact forms, and (on eligible plans) member accounts with a database.

2. Your account

• You must be at least 18 years old (or the age of majority where you live) to use LaunchPad.
• You're responsible for your account credentials and for everything done under your account.
• Information you give us must be accurate, and you must keep it up to date.
• We may verify your email address and take reasonable steps to confirm that accounts are genuine. Some sign-ups may be held for review or approval, and a new account may need a confirmed email and a payment method on file before it can publish a site or share a public preview. Adding a payment method is a security step and does not by itself result in a charge.
• You may invite co-authors to help build a site. As the site owner, you remain responsible for the site and for all charges it incurs, including work done by co-authors.

3. Billing, credits, and refunds

• Credits. LaunchPad uses a prepaid credit balance. Credits are applied first to your charges; any remainder is billed to your saved payment card. Credits have no cash value, aren't transferable, and (except where the law requires otherwise) aren't refundable.
• AI usage. Building and editing with the AI consumes credits based on the computing used, at the rates shown in the app.
• Subscriptions. Some services (for example site hosting plans) renew automatically, monthly or yearly as you choose, until you cancel. You can cancel any time from the app; the service stays active until the end of the period you've paid for, and no further renewals are charged.
• Free periods. Where a free period is offered (for example free hosting after your first publish), the paid plan begins when the free period ends. We'll tell you before that happens.
• Domains. Domain registrations are purchased from a third-party registrar on your behalf, with you as the registrant, and are non-refundable once registered. You agree to the registrar's registration agreement and applicable ICANN policies, including the requirement to provide and maintain accurate registrant contact information. Domains renew automatically by default (you can turn this off per domain); we send reminders before renewal and, if a domain expires unrenewed, further reminders during the recovery window before the registration is released.
• Prices. Current prices are always shown in the app before you buy. We may change prices; changes apply to future purchases and renewals, not to periods you've already paid for.
• No activation without payment. Paid services activate only after a successful payment.

4. Your content and sites

• You own your content. The text, images, files, and other material you provide, and the website content generated for you, belong to you.
• Our license to operate. You grant us the rights needed to run the Service: to host, store, process, back up, display, and publish your content, including processing the instructions and content you give the builder with our AI to generate your site.
• Published means public. When you publish a site, its content, including uploaded files, is publicly available on the internet. Don't upload secrets, private keys, or personal information you don't want public.
• Your responsibility. You're responsible for having the rights to everything you upload and publish, and for your site complying with the laws that apply to you and your visitors.

5. Acceptable use

You may not use LaunchPad to create, host, or distribute:

• anything illegal, or content that promotes illegal activity;
• malware, viruses, or other harmful code, or files designed to compromise devices;
• phishing, scams, or content that impersonates another person or business;
• content that infringes someone else's copyright, trademark, or other rights;
• spam or deceptive marketing, or attempts to manipulate search engines through deception;
• content that harasses, threatens, or is hateful toward others; or sexual content involving minors of any kind.

You also may not probe, overload, or attempt to gain unauthorized access to the Service or other users' sites and data.

Review and enforcement. To keep the Service safe, we may review sites automatically or manually, including when you publish or share a public preview. We may hold, block, remove, or take offline any content or site we reasonably believe violates these rules, and we may suspend or terminate accounts for serious or repeated violations. Most sites are never affected: a legitimate business, personal, or organization site is exactly what LaunchPad is for.

User content and responsibility. Sites on LaunchPad are created and controlled by their owners. We take reasonable steps to moderate content published through the Service, but we don't review everything in advance, and we're not responsible for content that users create, upload, or publish. Responsibility for a site and its content rests with its owner. If you come across a site built with LaunchPad that you believe is harmful or breaks these rules, please report it here so we can review it.

Copyright complaints. We respond to copyright infringement notices and counter-notices as described in our Copyright & Content Reports policy, and we terminate the accounts of repeat infringers in appropriate circumstances.

Sites directed at children. If your site is directed at children under 13 (or collects personal information from them), you are responsible for complying with the laws that apply, including the Children's Online Privacy Protection Act (COPPA). Don't collect personal information from children through your site unless you comply with those laws.

6. AI-generated content

LaunchPad uses artificial intelligence to generate designs, text, and code. AI output can contain mistakes. Review your site before publishing; you're responsible for what you publish. We don't guarantee that generated content is accurate, error-free, or unique.

7. Hosting, availability, and your data

• Sites are hosted while covered by a free period or an active hosting plan. If hosting lapses, we'll warn you; after a short grace period the site is taken offline. You can bring it back by choosing a plan and publishing again.
• Fair use: hosting plans are intended for ordinary business and personal websites, and plans include a stated storage allowance. Unusually heavy data transfer or usage patterns inconsistent with a typical website (for example, file distribution or media streaming at scale) may require an upgraded plan; we'll contact you before taking any action.
• If you delete a site, it's taken offline immediately and archived for about 30 days (during which it can be restored), then permanently deleted.
• We work hard to keep the Service available but don't guarantee uninterrupted operation. Maintenance, upstream providers, and events beyond our control can cause downtime.

8. Third-party services

Parts of the Service are delivered through trusted third parties, for example payment processing (Stripe) and domain registration. Their terms apply to their portions of the Service. We never see or store your full card number; payments are handled by Stripe.

9. Selling on your site

Some plans let you take payments on your site through your own Stripe account. Sales made on your site are between you and your customer: you are the seller of record, and you are responsible for your products and services, pricing, taxes, delivery, refunds, and disputes. LaunchPad is not a party to those transactions, doesn't process or hold those funds, and isn't responsible for what you sell. Your use of Stripe is governed by Stripe's own terms.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We don't warrant that your site will achieve any particular search ranking, traffic, or business outcome.

11. Limitation of liability

To the fullest extent permitted by law, LaunchPad and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless LaunchPad and its operator from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) content you create, upload, or publish through the Service; (b) your sites and how you operate them, including sales made on them and your treatment of your visitors' data; (c) your violation of these Terms; or (d) your violation of any law or of someone else's rights.

13. Termination

You can stop using LaunchPad and delete your sites at any time. We may suspend or terminate access for violations of these Terms, non-payment, or risk to the Service or other users. Where practical, we'll give you notice and a chance to export your content.

14. Changes to these Terms

We may update these Terms as the Service evolves. If a change is material, we'll notify you in the app or by message before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.

15. Governing law & contact

These Terms are governed by the laws of the United States and the state of Montana, without regard to conflict-of-law rules. Any dispute that isn't resolved informally must be brought exclusively in the state or federal courts located in Montana, and you consent to their jurisdiction. Questions?
